Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Yoga Wake Up, Inc. ("Yoga Wake Up," "we," "us," or "our"), the company that operates FitFutureMe ("FFM," "FitFutureMe," or "the App"). By creating an account, subscribing, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using FitFutureMe, you agree to be bound by these Terms and by our Privacy Policy. We may update these Terms from time to time; if we make material changes, we will provide notice (such as an in-app notice or updated "Last updated" date). Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

2. Description of Service

FitFutureMe is an AI-powered fitness transformation app that provides:

• Workout tracking — logging exercises, sets, reps, and workout history.
• AI food and calorie logging — photo-based analysis of meals to estimate nutrition and calorie content.
• AI-generated goal body visualizer — generates a projected "future you" image from a photo you upload, used to visualize a fitness goal.
• Weekly photo check-ins — periodic progress photos you submit to track visual change over time.
• An agentic AI coach ("Future-self coach") that reviews your in-app activity (such as missed workouts, streaks, and milestones) and, based on that behavior, may proactively and automatically initiate outbound contact with you — including phone calls, SMS text messages, and WhatsApp messages — without you first requesting that specific contact.

By providing a phone number and enabling the Future-self coach, you expressly consent to receive these automated and/or proactively-initiated calls, texts, and WhatsApp messages from us, which may be sent using an automatic telephone dialing system or similar technology. Consent to receive these messages is not a condition of purchasing any subscription available through the App generally, but is required to use the Future-self coach feature specifically. Message and data rates may apply. You can change your contact channel preferences or disable outbound coach contact at any time in Profile → Future-self coach settings, or by replying STOP to any SMS message.

3. Eligibility

You must be at least 18 years old to create an account or purchase a subscription. If you are under 18, you may only use the App with the involvement, supervision, and express consent of a parent or legal guardian, who must agree to be bound by these Terms on your behalf and takes responsibility for your use of the App. The App is not directed at children under 13, and we do not knowingly permit anyone under 13 to use it.

4. Medical Disclaimer

FitFutureMe, including any content generated by its AI coach, workout plans, nutrition estimates, or body visualizations, is provided for informational and motivational purposes only and does not constitute medical advice, diagnosis, or treatment. The App is not a substitute for professional medical judgment.

Consult a physician or other qualified healthcare provider before starting any new exercise program, changing your diet, or acting on any recommendation from the App — including recommendations delivered by the AI coach — especially if you have any pre-existing medical condition, injury, or health concern. AI-generated content may be inaccurate, incomplete, or inappropriate for your individual circumstances; use your own judgment and seek professional guidance before relying on it.

5. Assumption of Risk; Release and Waiver of Liability

Physical exercise carries an inherent risk of injury, including but not limited to muscle strain, sprains, fractures, cardiovascular events, and, in rare cases, death. Your participation in any workout, exercise, or fitness activity referenced or suggested by the App is entirely voluntary.

By using FitFutureMe, you acknowledge and voluntarily assume all risks associated with physical activity undertaken in connection with the App, whether or not that activity was suggested by the App's AI coach or workout plans. To the maximum extent permitted by applicable law, you release and waive any claims against Yoga Wake Up, Inc., its officers, employees, and contractors arising from injury, loss, or damage resulting from your use of the App or participation in any activity it suggests.

6. User-Submitted Content

"User Content" means any photo, image, or other material you upload, including food photos, goal-visualizer source photos, and weekly check-in photos.

• Ownership. You retain ownership of your User Content.
• License to us. By submitting User Content, you grant Yoga Wake Up, Inc. a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and analyze that content — including by transmitting it to third-party AI providers (see our Privacy Policy for which providers) — solely to provide the features you've requested (e.g., food analysis, goal visualization, check-in tracking).
• Content standards. User Content must be your own (or you must have permission from everyone shown), non-sexual, and must meet the clothing guidelines presented in-app at the point of upload.
• Moderation and rejection. We may review, reject, decline to process, or remove User Content that we believe, in our discretion, violates these Terms, our content guidelines, or applicable law — including content depicting non-consensual imagery, sexually explicit material, or minors. We have no obligation to proactively monitor User Content, and are not liable for User Content submitted by you or any other user.

7. Subscription and Payment Terms

FitFutureMe offers auto-renewing subscriptions, billed and processed through the Apple App Store or Google Play, with subscription management handled via RevenueCat.

• Free trial. We may offer a free trial period. Unless you cancel before the trial ends, it will automatically convert to a paid subscription and you will be charged.
• Auto-renewal. Subscriptions automatically renew for the same term unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation. You can cancel anytime through your Apple ID or Google Play account settings — cancellation is managed by the App Store/Play Store, not directly in-app. Cancelling stops future renewals but does not refund the current period.
• Refunds. Refunds are handled according to Apple's and Google's respective refund policies; we do not directly process refunds.
• Price changes. We may change subscription pricing; where required, we will provide notice before a price change applies to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available," without warranties of any kind, express or implied, including as to accuracy, reliability, or fitness for a particular purpose. AI-generated content (workout plans, nutrition estimates, goal visualizations, and coach messages) may be inaccurate and is not guaranteed.
• Yoga Wake Up, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.
• Our total liability for any claim arising out of or relating to these Terms or the App will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Putnam County, Florida, unless applicable law requires otherwise.

11. Miscellaneous

• Termination. We may suspend or terminate your access to the App at any time, including for violation of these Terms.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yoga Wake Up, Inc. regarding the App.
